Producer Responsibility
ZRN advocates on behalf of manufacturers and importers of solar panels who are subject to the Producer Responsibility. The WEEE directive deems that the company that first puts solar panels on the Dutch market holds the Producer Responsibility. Which company that is, depends on the particular situation.

A Dutch Manufacturer sells modules or inverters to a local Dutch Distributor such as a multi brand or single brand (Manufacturer owned) wholesaler, EPC, installer, roofer, building company or internet retailer. In some cases it could be a project developer.

A foreign Distributor sells modules or inverters directly to the End User in the Netherlands. A Distributor could be a multi brand or single brand (Manufacturer owned) wholesaler, EPC, installer, roofer, building company or internet retailer. In some cases it could be a project developer.
In this case, the foreign company holds the Producer Responsibility.
The Dutch regulation requires foreign companies that hold the Producer Responsibility to assign a so called Authorized Representative. This is a Representative that takes over the legal responsibility from the foreign organization. It complies with the Dutch legislation on behalf of its client. Foundation SAR is such a representative.
Please note that 'foreign' refers to a company being based outside of the Netherlands, independent if this is a country inside or outside of the European Union.

In this case, the foreign Manufacturer holds the Producer Responsibility.
The Dutch regulation requires foreign companies that hold the Producer Responsibility to assign a so called Authorized Representative with a legal identity in the Dutch market. This is a Representative that takes over the legal responsibility from the foreign organization. It complies with the Dutch legislation on behalf of its client. Foundation SAR is such a representative.

As indicated, the company that first puts solar panels on the Dutch market holds the Producer Responsibility. For solar panels – PV panels, PVT panels, and inverters – this could be a producer based in the Netherlands or an importer. Examples of importers are wholesalers, factory representatives, EPCs, fitters, roofers, contractors and internet sellers.
Another option is that the deliveries are done directly from abroad by a distributor or an international manufacturer. The Producer Responsibility then rests with the international company.
The WEEE requires these international companies to authorise someone on the Dutch market with Dutch legal representation for the Producer Responsibility.
